Your rights and responsibilities when using BrassNet
1. The Service We Provide
BrassNet is a platform built for Canadians who share a passion for the outdoors — whether it's hunting, fishing, sport shooting or exploring nature.
Our goal is to bring this community together by helping individuals, groups and businesses to connect, share and support one another in a safe and engaging environment.
On BrassNet, you can express yourself in many ways:
Customize your profile with content that reflects your interests
Use our marketplace to purchase or sell / trade your goods
Send direct messages with built-in media sharing to facilitate communication
Share updates, photos or videos
Promote your future events such as Gun shows
Create interest-based groups
We are always working to improve the platform and add new features based on community needs and feedback.
As part of our service, we may display sponsored or commercial content. This allows you to discover relevant products, services and promotions offered by Canadian businesses and organizations in the outdoor industry.
Community safety is at the heart of BrassNet.
We take security seriously — that includes the availability, accuracy, integrity and privacy of our services. If we detect or are made aware of content or behavior that could harm others or the community, we may take appropriate steps. These could include:
Issuing warnings or guidance
Removing harmful or inappropriate content
Temporarily restricting features
Disabling or deleting accounts
In serious cases, notifying relevant authorities
2. Your Commitment to Using BrassNet
BrassNet is built to serve the community — but it can only succeed if everyone respects a few key principles. By using our platform, you agree to uphold the integrity, safety and purpose of the space we're creating. Here's what that means in practice:
2.1 Who Can Join and Use BrassNet
To help maintain trust and accountability, every member of BrassNet must meet the following requirements:
Use your real identity. You must register using the name you go by in everyday life. You can still choose a username that's visible to others.
Keep your information accurate. You're responsible for ensuring your profile reflects who you are.
Create and use only one personal account. This is to reduce confusion and prevent fraud.
Keep your account secure. Do not share your password, give access to others, or transfer your account to someone else unless we authorize it.
BrassNet is intended to be a safe and legal space. For this reason, you cannot use our platform if:
You are under 18 years old.
You are legally prohibited from possessing firearms, ammunition, knives, or related items.
You have been convicted of firearms-related offenses at any time.
Your account was previously removed or suspended for violating our Terms or Community Standards. Rejoining requires our explicit permission and does not imply the previous suspension was in error.
You are barred from accessing our services under Canadian law or other applicable regulations.
We reserve the right to verify your identity or eligibility at any time.
2.2 What You Can Share and Do on BrassNet
BrassNet encourages open, honest and respectful expression — as long as it doesn't compromise the safety or experience of others. By using our platform, you agree not to share or engage in content or behavior that:
Breaks Canadian law or these Terms.
Is false, misleading, deceptive or harmful.
Infringes on intellectual property rights (copyright, trademarks, etc.) without proper authorization.
Harasses, threatens, discriminates or otherwise causes harm to others.
If we find that the content you've posted violates our policies, we may remove it and, in some cases, restrict or disable your account. Where possible, we'll notify you and provide a way to request a review — unless doing so would create legal or safety risks.
2.3 Accuracy of User Information
When you register on BrassNet, you provide information that helps us maintain a trusted community. You may update or correct your details at any time through your account settings. However, BrassNet is not responsible for verifying the accuracy of user-submitted information. It's your responsibility to keep your profile truthful and up to date. To minimize the risk of abuse, each individual is allowed only one personal account.
2.4 Your Content and the Permissions You Give Us
We respect your rights to the content you create. Anything you upload — such as photos, videos, or written posts — remains your intellectual property.
However, by posting content on BrassNet, you give us permission (a limited license) to use, display and distribute that content strictly for the purpose of running and improving the platform. This permission allows us to make your content visible where you've chosen to share it — in news feeds, group pages, profiles or elsewhere.
You are always free to delete your content. If you delete your account, all personal content linked to it will also be removed from public view.
2.5 Our Intellectual Property
BrassNet retains full ownership of all branding, designs, platform features and content created by our team. You may not use our logos, design elements or other protected materials without prior written permission.
3. Additional Provisions
3.1 Updates to These Terms
BrassNet is an evolving platform. As we improve our services, introduce new features or respond to legal changes, we may need to update these Terms to reflect how we operate.
We'll only make updates when it's necessary — for example, to better protect our community, to reflect new functionality or to comply with laws and regulations. We will always aim to keep these changes reasonable, transparent and considerate of your experience.
Whenever we revise these Terms:
We will notify you in advance — usually by email or a message through the platform — at least 30 days before the changes take effect (unless the changes are required by law or are urgent for safety reasons).
If you continue using BrassNet after the updated Terms come into effect, it means you agree to the new version.
3.2 Account Suspension or Termination
We're committed to providing a space where members of Canada's outdoor, hunting and sport shooting community can interact freely and safely — something that isn't possible on many mainstream platforms. This includes allowing the legal trade of firearms and related items under strict community and legal guidelines.
To protect this freedom and keep the platform safe for everyone, we reserve the right to suspend or permanently disable your account if, in our judgment, you:
Clearly or repeatedly violate our Terms
Share unlawful or prohibited content
Infringe on the rights of others (such as repeated copyright or trademark violations)
Engage in conduct that endangers the safety, integrity or legal compliance of the platform
Attempt to create or use an account after being suspended without our permission
We may also suspend or delete your account if:
It is unconfirmed or inactive for an extended period of time
We detect unusual or unauthorized access and are unable to confirm that you are the rightful owner
Where possible, we will notify you before taking action and explain your options to request a review. However, we reserve the right not to provide advance notice if doing so would cause harm, interfere with our services or breach legal obligations.
4. Marketplace Rules
The BrassNet Marketplace is intended to help members of the community responsibly buy, sell, or trade items related to hunting, fishing, sport shooting and outdoor activities. To maintain the integrity and safety of this platform, all users — whether private individuals or businesses — must follow the rules below when using the Marketplace.
4.1 What You Can Post
You may only list items that fall within the current categories and subcategories defined on BrassNet. Items that do not fit within our listed structure may be removed.
Each listing must accurately reflect the item(s) for sale. If you're selling a group of items as a lot, they must be sold together — do not sell items separately if they're advertised as a lot.
You cannot post multiple firearms in the same ad unless they're sold as a lot.
4.2 Image Requirements
You must upload original photos of the actual item you are selling.
Do not use stock images, product photos from manufacturers, or images pulled from the internet.
Listings with non-original photos may be removed, and your account may be restricted or blocked.
4.3 Communication and Conduct
Inquiries made through the Marketplace must be respectful and relevant to the item listed.
Buyers should only contact sellers with genuine interest in a transaction.
4.4 Pricing and Deal Agreements
If you list an item with a fixed price, you are expected to honor that price. Take time to research fair market value before posting.
Once both parties have agreed to a deal, both the buyer and seller are expected to follow through. Backing out after agreement undermines trust.
Business inventory may only be posted under a valid business account. Personal accounts may not list products on behalf of a business or store.
4.5 Platform Role and Responsibilities
BrassNet is not involved in transactions between buyers and sellers. We do not handle payments, shipping, guarantees or mediation.
We are not responsible for the accuracy, condition, or truthfulness of items listed. That responsibility lies entirely with the seller and the buyer.
All members engage in private transactions at their own risk. BrassNet provides a platform for listing and discovery only — we are not a party to any agreement or sale.
4.6 Ad Quality and Moderation
We reserve the right to remove, edit, or decline any ad that does not meet our quality standards or violates the structure of the Marketplace. Examples of ads that may be edited or removed include:
Ads that combine unrelated items or mix items from different categories (unless sold as a clear, single lot)
Listings with incorrect fields selected in the submission form (e.g., wrong category, condition or other)
Ads with unclear descriptions that do not adequately explain what is being offered
Posts that do not follow our naming, formatting or content guidelines
Our goal is to maintain a clean, consistent, and trustworthy marketplace for all users.
5. User Messaging
BrassNet includes a built-in private messaging system that allows users to communicate directly with each other. This feature is designed to support respectful, community-driven conversations around shared interests such as buying, selling, organizing events or exchanging ideas.
By using this messaging tool, you agree to the following:
You are solely responsible for the content of your messages and how you use the messaging feature.
You may not use the messaging tool to harass, threaten, mislead, defraud or otherwise harm others.
BrassNet does not monitor private messages as a general practice and assumes no responsibility for the content exchanged between users.
However, we reserve the right to access, review or disclose message content only if required by law or if we believe, in good faith, that it is reasonably necessary to:
Comply with a legal obligation, regulation or court order.
Investigate a reported violation of our Terms of Use or Community Standards.
Prevent or respond to fraud, abuse, harassment or threats to individual safety.
Protect the rights, property or security of BrassNet, its users or the public.
We encourage all users to exercise caution and respect in private conversations. If you receive messages that are abusive, suspicious or appear unlawful, please report them to us immediately so we can take appropriate action.
6. Member Ratings & Reviews
BrassNet allows users to leave ratings and reviews about other members after completing a transaction. This system is meant to foster trust, transparency and accountability within the community — and it works best when used fairly and honestly.
To ensure the integrity of member reviews, the following rules apply:
You may only leave a review for a member if you have participated in a confirmed transaction with this person. This includes:
Agreeing on a deal (verbally or in writing)
Exchanging payment or goods (online or in person)
Completing the transaction, whether it went smoothly or had issues
Do not leave a review if you were simply in discussions and no agreement was reached. Reviews should reflect actual transactions, not general impressions or unresolved disputes.
Each party may post only one review per transaction.
We reserve the right to remove reviews that violate this policy or that we deem abusive, misleading or inappropriate.
If you feel you've received a review that is unfair or violates these guidelines, please report it to our team for review.
Notice: Fake reviews will get you permanently banned.
7. Messaging and Communication
By using BrassNet, you agree to receive communications from us — including notifications, updates, and important service information — through your account's private messaging system and the email address you provide.
These communications may come directly from BrassNet or on behalf of our affiliated partners, such as service providers or verified business members. They are intended to help you stay informed about your account, community activity, promotions, security updates or relevant changes to our services.
While we strive to ensure all communications are respectful and relevant, you understand and accept that by maintaining a BrassNet account, you consent to receiving such messages as part of your use of the platform.
You also agree to release and hold harmless BrassNet and its affiliated teams (including partners, employees, contractors, service providers, and legal representatives) from any claims, costs or consequences arising from the delivery of such messages to your account or email — provided they are sent in accordance with our Terms and applicable laws.
8. Errors and Accuracy of Information
While we do our best to maintain accurate and up-to-date information on BrassNet, we cannot guarantee that everything you see on the platform will always be correct or current.
This includes — but is not limited to — listings, prices, product descriptions, service details, promotional offers, availability or any other information shared by users or advertisers. Some of the content you'll see is provided directly by businesses or individual members, and BrassNet does not verify or endorse every detail.
We make no guarantees, warranties or promises about the accuracy, reliability or completeness of the information available on the platform. Prices and availability can change without notice.
All transactions are made at your own discretion and risk.
9. Privacy
When you use BrassNet, you trust us with your personal information — and we take that responsibility seriously.
We collect and use the information you provide to operate the platform, deliver services, personalize your experience and ensure the security and integrity of the community. This may include your name, contact details, profile information and activity on the platform.
By creating an account and using BrassNet, you agree to our collection and use of your personal data in accordance with these Terms.
Your Rights Under PIPEDA
In accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), you have the right to:
Access the personal information we hold about you;
Request correction of any inaccurate personal information;
Request deletion of your personal data and account;
Withdraw consent for certain data processing activities.
You may request deletion of your account and personal data at any time through your account settings or by contacting us directly. We will process your request in accordance with applicable laws and regulations.
We do not sell your personal information. However, we may share certain information if required by law, or if we reasonably believe it's necessary to:
Comply with a legal obligation or official request;
Investigate or respond to a breach of our Terms;
Prevent or address unlawful activity or threats to the safety of any person;
Cooperate with law enforcement agencies or regulators in Canada or other applicable jurisdictions.
Your privacy matters to us, and we aim to be as transparent as possible about how your information is used and protected.
10. Disclaimers
BrassNet is a platform for the community — but how you use it is ultimately up to you. You are fully responsible for your actions, your content, and your decisions while using the platform.
We provide the website and its services "as is" and "as available." This means we do not offer any guarantees — explicit or implied — about the platform's content, features or availability. BrassNet makes no warranties regarding the accuracy, reliability, suitability or completeness of any material, information, product or service you access through the platform.
To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
Implied warranties of merchantability or fitness for a particular purpose
Non-infringement of third-party rights
Conditions related to performance, content quality or results from using the platform
In addition, BrassNet may allow you to engage in commercial transactions with other users. These interactions are entirely at your own risk. We do not control, verify or guarantee any aspect of these transactions, including product quality, pricing, delivery, communication or outcomes. Any decisions you make based on listings or information found on BrassNet are solely your responsibility.
Use common sense, be cautious and verify information before committing to any transaction. BrassNet does not offer personal or commercial advice, nor do we intervene in buyer-seller disputes.
11. Third-Party Content and Transactions
BrassNet may display promotions, advertisements or links to websites, products or services offered by third parties ("Third Parties" or "Third Party Sites"). These are provided for your convenience and to help you discover related offerings within the outdoor, hunting, sport shooting and outdoors community.
However, BrassNet is an independent platform and does not endorse, control or take responsibility for any Third Party or their services. This includes:
Products or services advertised on our platform
Content or offers on linked Third Party websites
Information or claims made by outside businesses or individuals
Any interaction you have with a Third Party — including browsing, messaging, purchasing or receiving services — is entirely between you and that Third Party. We are not involved in those dealings and cannot guarantee anything related to pricing, delivery, service quality or fulfillment.
You are solely responsible for evaluating Third Party websites, offers or content. BrassNet makes no warranties about their accuracy, reliability or safety. If you choose to engage with a Third Party, you do so at your own risk.
The presence of a link or promotion on BrassNet does not imply endorsement or partnership, nor does it grant any right to use BrassNet's name, logo or branding in association with those Third Parties.
BrassNet is not liable for any loss, damage or issue arising from your use of or reliance on Third Party content, websites, products or services — whether accessed directly or through links provided on our platform.
12. Miscellaneous
This document represents the entire agreement between you and BrassNet regarding your use of the platform and its services. It replaces any previous agreements, discussions or understandings between you and us.
If we choose not to enforce a particular provision or right under this agreement, it doesn't mean we've waived that right — and it doesn't prevent us from enforcing it in the future.
If any part of this agreement is found by a court to be invalid, unlawful or unenforceable, the rest of the agreement will still apply. Only the affected section will be removed or revised, while the remaining terms stay in effect.
Your relationship with BrassNet is that of an independent user. Nothing in these Terms creates a partnership, joint venture, employer-employee relationship or agency of any kind.
